Possession
Possession of commercial non residential property.
Forfeiture of lease: 
Under the law of property Act 1925: 
Notice section 146.
 
Forfeiture meaning the act of surrendering something as a penalty or failure to adhere to the terms and conditions as set by an agreement.
 
In the case of Landlords with commercial property, agreement meaning lease.
Subject to the terms of lease, a breach of conditions normally unpaid rent can allow the landlord to serve notice section 146 and proceed with possession of the property/premises.
 
Where the property is of commercial (non residential premises) no lengthy court action or proceedings are required.
 
To determine the terms and conditions of the lease it is strongly advised that the Landlord consult a Solicitor before instructing forfeiture. Outstanding arrears of Service charges and insurances can no longer be considered as, default of the terms of lease enforcing possession as, a debt.
 
On written instructions only, the City of London Bailiffs will take possession of commercial premises after, the Landlord's notice of intentions to the tenant has been deemed as default.  
 
The Police will be informed of our intentions and a CAD number issued, on completion of possession the Police will again be inform and a reference number obtained.
 
We will arrange our locksmith to attend, force entrance and change all locks. We will also arrange sitex where needed and the disposal of all perishable matter.
 
Once the property is secure, a City of London Bailiff will display notices at the property informing any body who tries to gain entrance will be committing, a breaking and entering offence.
 
The displayed notices will give the Bailiff's (Key holder) phone number to anyone who may have a claim to any goods left on the premises, requesting contact within seven days to arrange collection with proof of ownership of any such goods.
 
If the Landlord requests all the goods to be removed and sold at auction to recoup the loss of unpaid rent (After the next rent due date) we are happy to assist.
 
In the event where the Landlord feels the property is likely to be unlawfully re-entered, we are happy to supply 24/7 static security, dog patrol or CCTV monitoring, if requested.
 
If the Landlord requests the property to be cleared of all goods and rubbish, then yet again we are willing to assist.

We only collect Commercial rent arrears.

We do not collect commercial arrears of outstanding Insurances, utility service bills, surcharges or any other outstanding arrears accumulated by the Tenant other than rent. In the case of the Landlord instructing us on false information leading to misrepresentation, the Landlord will be charged in compliance with the mandatory Bailiff attendance fee. 
 
Bailiffs costs for forfeiture of lease £196.00 + Vat.
 
The City of London Bailiffs collect commercial rent on behalf of our Landlord clients without charge.

Vehicle asset re-possession
 
Our highly skilled team will seize:
Vehicles. Plant Machinery. Caravans. Boats. Motorcycles.
 
Under the instructions of finance companies, leasing and hiring companies, fleet companies, and with proof of ownership and of default, we will return the goods to any destination.
 
In most cases the person in possession will relinquish the keys and in the most common cases, the vehicle can be driven away.
As a secondary precaution an HPI check will be made on site and the VIN confirmed before any actions are taken. Our experienced officers will also conduct a safety check on the vehicle before driving it away. A written notice will be left with the person who was in possession of the goods.
 
In the event where the goods cannot be driven away: Unroadworthy vehicle, boat or heavy plant machinery a low loader will be called to assist. Caravans that can towed away and motorcycles that can be ridden away will done so by our Bailiffs.
 
This service is confined to an outer sixty mile radius of the M25 in regard to collection, with no limit to returned destination within the UK.
 
Costs for returned vehicle £265.00.
Low loader assistance average costs £200.00.
An out of London mileage rate of 65p per mile applies to all vehicles.
